realestatelaw.ae is published by Cendale Documents Clearing Services FZCO (Trade Licence 78065), a documents-clearing and transfer-execution company. We are not a law firm and do not provide legal representation. Matters requiring legal advice or court representation are referred to independent licensed advocates.
Which do you need
For a standard Dubai property transfer, the work is procedural: documents, the developer NOC, bank letters, the trustee appointment. That is conveyancing. A lawyer is the right professional when the matter is contested, heading to court, or turns on legal rights rather than process — disputes, fraud, inheritance, developer default. This page maps which is which.
| Role | Does | Incentive | Regulated by |
|---|---|---|---|
| Conveyancer | Executes the transfer process end to end | Completion of the file | Commercial licensing |
| Broker | Brings buyer and seller together | The commission on closing | RERA broker registration |
| Advocate (lawyer) | Advises on rights; represents in disputes and court | The client’s legal position | The advocates’ roll |
| Scenario | Who you need |
|---|---|
| Standard resale, both parties willing | Conveyancer |
| Sale with a seller mortgage | Conveyancer |
| Purchase with buyer financing | Conveyancer |
| Gift transfer between first-degree relatives | Conveyancer |
| Off-plan handover and title registration | Conveyancer |
| Corporate transfer with clean documents | Conveyancer |
| Deal fallen through; deposit contested | Lawyer |
| Developer reneges or delays beyond contract | Lawyer |
| Suspected fraud or forged documents | Lawyer |
| Inheritance and succession | Lawyer |
| Divorce-related transfer of ownership | Lawyer |
| Court-ordered sale or execution | Lawyer |
The dividing line: if the outcome depends on a decision-maker — a judge, a committee, a counterparty who must be compelled — you need an advocate. If the outcome depends on paperwork arriving in the right order, you need a conveyancer.
Court representation in the UAE is reserved to licensed advocates. Anything that is heading to litigation — claims, defences, enforcement — belongs with a law firm from the outset. Engaging one early, before positions harden, is consistently cheaper than after.
Legal work is typically engaged hourly or on retainer, scaled to the dispute. Conveyancing at its best is a fixed fee for a defined process, identical whatever bank, broker or developer is involved. The two are not substitutes: one prices risk and advocacy, the other prices execution.
For execution of an uncontested transfer, the fixed-fee service is at conveyance.ae. For dispute pathways short of court — developer and rental matters — see dispute.ae. Litigation itself belongs with an independent licensed law firm.
For a standard purchase, no — the process is procedural. For contested, cross-border or estate matters, yes.
No. Representation is advocates’ work; a conveyancer executes process, not claims.
No; parties attend in person or through a properly attested power of attorney.
As soon as the developer’s performance departs from the contract — delay beyond the grace period, specification changes, or handover refusal.
